Throughout these Terms & Conditions, “MartianCrown”, “we”, “us”, or “our” refers to PreneurShip operating under the brand name MartianCrown, and “you” or “user” refers to any individual or entity using or accessing our services.

By accessing or using martiancrown.com and our services, you agree to be bound by these Terms & Conditions. If you do not agree, you should not use our services.

2. Service Description

MartianCrown is a Software-as-a-Service (SAAS) platform offering AI-powered personal portfolio websites, portfolio-generation tools, and related digital services delivered online via subscription plans.

Some services may include recurring billing (such as monthly, annual, or custom billing cycles) processed securely via third-party payment processors, including Razorpay. We may update or improve features from time to time, but the core nature of the service remains the provision of AI-powered portfolio and related digital tools.

3. Eligibility & Account Registration

To use MartianCrown, you must be legally capable of entering into a binding contract under applicable law and provide accurate and complete information when creating and maintaining your account.

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities that occur under your account.

If you believe your account has been compromised, you should contact us promptly at admin@martiancrown.com.

4. User Responsibilities

When using MartianCrown, you agree to use the platform lawfully and appropriately and to provide accurate information.

• Provide correct and up-to-date account, profile, and payment information, and update it when it changes.
• Do not misuse the platform, attempt to bypass security, or access data not intended for you.
• Do not engage in scraping, reverse engineering, or automated abuse beyond permitted usage limits.
• Ensure that content you provide does not violate any laws or infringe third-party rights.

We may suspend or terminate your access if we reasonably believe you have violated these responsibilities.

5. Subscriptions, Billing & Payments

MartianCrown may offer subscription plans (for example, monthly, annual, or custom billing cycles). By subscribing to a paid plan, you authorize us to charge the applicable fees on a recurring basis until you cancel.

• Payments are processed securely via Razorpay and other trusted third-party payment processors.
• Billing details (such as name, email, phone number, transaction amount, and timestamps) may be shared with payment processors for payment processing, verification, and fraud prevention.
• Credit and debit card details are not stored on MartianCrown servers and are handled by the payment processors.
• Payment failures may result in temporary suspension or downgrade of access to paid features until resolved.

We may update subscription fees from time to time and will provide reasonable notice of material changes. Continued use of the service after a price change takes effect constitutes acceptance of the new pricing.

6. Refunds & Cancellations

Refunds, where applicable, are governed by our dedicated Refund & Cancellation Policy.

7. Intellectual Property

All rights, title, and interest in and to the MartianCrown platform, including software, code, design, user interface, branding, logos, text, graphics, and other materials (collectively, the “MartianCrown Materials”), are owned by PreneurShip or its licensors.

• We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the platform solely for creating and managing your portfolio.
• You may not copy, modify, distribute, or exploit the MartianCrown Materials without our prior written consent.

8. User Content

You retain ownership of the content you provide (such as biography, work history, and uploaded media). You grant us a limited license to host, process, and display this content solely to operate and improve the service.

You are responsible for ensuring that your content is accurate and lawful. We may remove or restrict content that we reasonably believe to be unlawful, harmful, or in breach of these Terms.

9. Third-Party Services

MartianCrown integrates with third-party services, including Supabase, Razorpay, Resend, OpenAI, and OAuth providers such as Google and LinkedIn.

Your use of these services may be subject to their own terms and privacy policies. We do not control and are not responsible for the performance, availability, or policies of these third-party providers.

10. Limitation of Liability

To the maximum extent permitted by applicable law, MartianCrown is provided on an “as-is” and “best-effort” basis. We do not guarantee uninterrupted or error-free operation.

• PreneurShip will not be liable for indirect, incidental, consequential, special, or exemplary damages, or for loss of profits, revenue, data, or business opportunities.
• Where our liability cannot be fully excluded, it will be limited, to the extent permitted, to the amount you have paid for the service in the three months immediately preceding the event giving rise to the claim.

11. Termination & Suspension

We may suspend or terminate your access to MartianCrown if you misuse the platform, fail to pay applicable fees, or violate these Terms or other applicable policies.

Upon termination, your right to use the service will cease. We may retain certain data as required for legal, security, or financial compliance purposes, consistent with our Privacy Policy.

12. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of India. Any disputes arising out of or in connection with these Terms or your use of MartianCrown shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal, India.

13. Changes to These Terms

We may update or modify these Terms & Conditions from time to time. When we make significant changes, we will take reasonable steps to notify you, such as via the website, dashboard notifications, or email. Continued use of MartianCrown after updated Terms take effect constitutes your acceptance of the revised Terms.
